Miller Law Group secures big win for employers in California

In a published decision and a win for employers that use arbitration agreements, the District Court for the Northern District of California has upheld an arbitration agreement over an employee's claims that the agreement did not meet California standards for the arbitration of discrimination claims and was an unlawful contract of adhesion. The case is Cornejo v. Spenger's Fresh Fish Grotto (N.D. Cal. May 17, 2010) 2010 U.S. Dist. LEXIS 48354.

Miller Law Group attorneys Janine Simerly, Claudia Castillo, and Noah Levin represented Spenger's and its parent company McCormick and Schmick Restaurant Corp. on its motion to compel arbitration.

On October 14, Miller Law Group hosted a meeting of the San Francisco Chapter of the International Network of Boutique Law Firms (INBLF). Miller Law Group is a member of the INBLF, which is an organization of highly credentialed single-discipline (boutique) law firms, each of which has been identified and hand-selected as prominent in their respective field of practice. Currently, the INBLF has nearly 300 member firms in more than 40 major cities throughout the United States and Canada. On October 5th-7th 2009, Miller attorneys attended the National Association of Minority and Women Owned Law Firms (NAMWOLF) annual meeting in Chicago. Miller shareholder Lisa Hamasaki participated on a panel presentation, “Litigation Ethics in the Electronic Age – From Facebook to Forensics.” Ms. Hamasaki spoke about the ethical risks of conducting internet investigations during litigation, including using Facebook and other social networking sites. NAMWOLF was established in 2001 with the purpose of encouraging major corporations and public entities to utilize the services of minority and women-owned law firms.

Miller Law Group Wins Defense Verdict in Race and Retaliation Case

On July 30, 2009, Miller Law Group shareholder Janine Simerly won a complete defense verdict on behalf of McCormick & Schmick Restaurant Corp. and two individual defendants in a hotly contested racial discrimination and retaliation lawsuit. The jury trial in Alameda County Superior Court lasted six weeks, culminating in the jury's verdict in our clients' favor. The plaintiff in the suit, represented by Angela Alioto, sought over $1 million in economic and emotional distress damages, as well as unspecified punitive damages.
