Employment Law Update Web Seminar on August 19, 2010: Retaliation and Whistleblowing Claims: What Employers Need to Know

The U.S. Equal Employment Opportunity Commission reports that retaliation claims are now the most commonly filed claims. In 2009, for example, such claims amounted to 36% of all charges filed with the EEOC, up from 28.6 percent five years ago. Similarly, the California Department of Fair Employment and Housing reports that 37% of the complaints filed with it alleged retaliation. Join us for our next web seminar, in which we will explore how recent legal developments under California and federal law are fueling this rise in retaliation complaints. We will also examine the latest cases and regulatory changes in whistleblower protection and public policy lawsuits, and provide best practices to implement to prevent having to defend such claims in court. Topics we will cover in depth include:

  • How recent federal and state retaliation decisions have opened the door for more retaliation claims.
  • What employees must show to establish a retaliation claim and the types of employer actions that can lead to trouble.
  • Liability based on "associational" retaliation.
  • Expanding whistleblower protections under recently enacted laws including the Dodd-Frank Wall Street Reform and Consumer Protection Act.
  • Recent cases analyzing employee public policy claims.
