LITIGATION
- Won a complete defense verdict on behalf of a national restaurant chain, following a jury trial in Alameda County Superior Court in a lawsuit alleging race discrimination and retaliation.
- Won summary judgment in federal court on behalf of a major food product manufacturer, where the allegations included wrongful termination and retaliation for reporting alleged workplace safety violations.
- Secured summary judgment in an ERISA action in favor of a welfare benefit plan, and obtained District Court’s denial of plaintiff’s cross motion for summary judgment.
- Prevailed in federal court on a motion for summary judgment and on appeal before the Ninth Circuit in favor of a major corporation faced with claims under Title VII and the ADEA.
- Successfully defended a major corporation at trial in San Francisco Superior Court and on appeal, in a multiple plaintiff race discrimination, harassment and retaliation lawsuit.
- Won summary judgment and successfully defended an appeal to the Ninth Circuit, in a case involving claims of race and sexual orientation discrimination and retaliation.
- Obtained summary adjudication of an age discrimination claim in San Mateo Superior Court, and obtained settlement for a nominal sum on a contract claim of 30+ year employee.
- Obtained temporary restraining orders on behalf of several employers to prevent workplace violence and/or harassment of their employees.
CLASS ACTION
- Represented a major restaurant chain in a wage and hour class action and reached settlement of less than $350,000 for 3,000 employees.
- Successfully demurred to California Business and Professions Code § 17200 claim, disposing of representative class of 23 employees who alleged they were misclassified as exempt employees, and causing the remaining two plaintiffs to substantially reduce their settlement demand.
- Represented a major energy resource corporation in alleged misclassification of station managers.
- Represented a staffing services company in challenge to commission plan exemption (won summary adjudication of state law claim; settled federal law claims).
ADMINISTRATIVE
- Represented a major paint manufacturer and supplier, and achieved a finding by the California Department of Fair Employment and Housing of insufficient evidence to prove unlawful disability/medical leave discrimination.
- Represented a major ski resort before the California Labor Commissioner, and achieved dismissal and settlement of exempt misclassification claims.
